Who is this Privacy Statement intended for?

This Privacy Statement primarily concerns the processing of personal data of representatives or employees of our current and former members, our prospective clients, our partners and the persons with whom Algemene Borgstellingen is in contact in connection with its mandate and activities.

What personal data does Algemene Borgstellingen process and what is the purpose of this processing?

Algemene Borgstellingen keeps the following personal data:  

  • Your contact details, for example: first name, last name, form of address, language, professional and/or private e-mail address, professional and/or private telephone number, position within your organisation, IP address; in addition, for Algemene Borgstellingen employees: bank account number, place and date of birth, national register number, home address, family composition, etc. 

If you are a director or employee of a shareholder of Algemene Borgstellingen, we use this data in connection with the running of the business and the services provided by the aforementioned company to its shareholders, as described in the articles of association.

For all other categories of persons, the data processed will be used solely in connection with the mandate and activities of Algemene Borgstellingen.
If you are a director or employee of a company that has a contractual relationship with Algemene Borgstellingen, such as a supplier, partner, shareholder, beneficiary of a guarantee, etc., we use this data in connection with the performance of this contractual relationship.

If you contact Algemene Borgstellingen, for example with a request for information, we use this data in connection with the handling of your request.

    your data are processed in connection with the mandate of Algemene Borgstellingen, as described in the articles of association.

Transfer of your personal data to third parties

In principle, your data will not be disclosed to third parties without your consent.
However, in certain exceptional cases your personal data may be disclosed to third parties without your consent. More specifically:

  • to subcontractors in connection with activities related to the mandate of Algemene Borgstellingen
  • to competent authorities or bodies designated by law in the context of legal and regulatory obligations.

How long does Algemene Borgstellingen retain your data?

Algemene Borgstellingen retains your personal data for up to seven years after the end of your relationship with Algemene Borgstellingen e.g. if you are no longer a director or employee of (a shareholder of) Algemene Borgstellingen, etc., unless a statutory retention period applies, such as a statutory limitation period or any applicable legal appeal period, or unless you expressly request that your data be deleted.

No automated decision-making

Algemene Borgstellingen does not base the processing of personal data solely on automated decision-making under any circumstances.

We do everything in our power to secure your personal data as effectively as possible and protect your privacy as much as possible. We take all the technical and organisational measures necessary for this purpose.

You can always access your data upon first request.

If your data are incorrect, you can ask Algemene Borgstellingen to correct, supplement and/or update them.

Your data are transferable when they are processed with your consent and/or by automated means.

In certain cases, as provided for by Articles 17, 18 and 21 of the General Data Protection Regulation, you may object to the processing of your data by Algemene Borgstellingen and/or request that Algemene Borgstellingen delete your data.

If the processing of your data is based on your consent, you may withdraw your consent at any time. This withdrawal will apply only to the future.
